The Swedish telecommunications equipment maker, Ericsson, launched a patent suit against Samsung at the District Court for the Eastern District of Texas, after the two years negotiations between the two companies failed.
Samsung already licensed Ericsson`s patents in 2001 and renewed terms in 2007, but the licenses have now expired and according to Ericsson Samsung refused to renew its licensing agreements.
It seems that the two companies failed to reach an agreement about renewing patent licensing deals on FRAND terms (fair, reasonable and non-discriminatory), which are used by the industry to set standards for technology and products.
Thereby, Ericsson decided to take legal action as it “must take action to support a crucial system for technology sharing that has helped create today`s mass market communications industry”.
